Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Dr. Peter Mayer, Würzburgerweg 18, 4840 Vöcklabruck, Austria, phone +43 699 81816699, email support@bitsound.com) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

You can also exercise your right of withdrawal online with the function "Withdraw from contract" on this page. If you use this function, you will receive an acknowledgement of receipt on a durable medium without delay, for example by email, with the content of your statement and the date and time of its receipt.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

If you paid with credit, we credit the amount back to your credit balance.

Early expiry for music downloads

When you buy music to download (digital content not supplied on a tangible medium), your right of withdrawal expires early if we have begun providing it before the end of the withdrawal period after

1. you have expressly agreed that we begin providing it before the end of the withdrawal period,
2. you have acknowledged that you thereby lose your right of withdrawal, and
3. we have provided you with a confirmation of the contract including this consent (§ 18(1) no. 11 FAGG).

On Bitsound you give this consent before every purchase with a separate checkbox. You receive the contract confirmation including your consent and acknowledgement by email, together with the terms and conditions as a text attachment. The music is available for download immediately after the purchase.

This also applies if you buy music as a gift: the provision starts with the gift code, you give the consent and acknowledgement when buying.

Topping up credit

Top-up and music purchase are separate transactions. For top-ups we grant you in any case a contractual right to a refund within fourteen days of the top-up. Statutory rights of withdrawal exist alongside and are not limited by it.

If the credit from this top-up is entirely unused, we refund the full top-up amount including the service fee. If the credit is partly used, we refund the unused part of this top-up and the corresponding share of the service fee, in proportion of the unused part to the top-up amount. For this allocation the oldest top-ups are used first. You receive a clear statement.

Music purchases already validly concluded and the credit used for them remain in place with this contractual refund. Statutory rights regarding the top-up or a single music purchase, including further refund claims, remain unaffected. For the statement, meeting the deadline and payment, the channels and periods described above apply accordingly.

Vouchers from Bitsound are free, there is nothing to refund for them. For gift cards bought earlier the right to a refund applies accordingly as long as the gift card has not been redeemed: you get the gift card amount back including the service fee, the code becomes invalid. Once the gift card is redeemed, the credit belongs to the recipient. Statutory rights remain unaffected.

Storage plans for artists

If you buy a storage plan as a consumer, you can withdraw from the contract within fourteen days of concluding it. We then refund the full price.

If you have expressly requested that the plan starts during the withdrawal period, and we have informed you about withdrawal and proportionate payment, we only keep a proportionate amount for the time until the withdrawal and refund the rest (§ 16 FAGG). Without your express request we refund the full price. Merely activating the annual plan does not end your right of withdrawal.
